1. Overview & Consignment Agreement

• Agency Basis: Shush operates as a consignment agent for the sale of luxury handbags, accessories, footwear, and clothing. Title/ownership of the item remains with you (the "Seller/Owner") until the item is sold.

• Consignment Period: All items accepted for sale will be displayed and marketed for an initial period of 3 calendar months.

• Early Removal: Shush reserves the right to terminate the sales agreement and return any item to the Owner prior to the expiration of the 3-month period.

• Consignment Term End: After the 3-month period, if your item remains unsold, we will contact you via phone and/or email. You may arrange to collect your item within 14 days, or agree with us in writing to extend the sales period.

2. Acceptance, Collection & Unsold Items

• Unaccepted Items: Any items not accepted for sale—whether refused by Shush or where a selling price cannot be agreed upon—must be collected within 14 calendar days of notification.

• Uncollected Merchandise: Any item not collected within 14 days of notice (whether rejected initially or unsold after the 3-month term) will be donated to a charity of our choice or disposed of.

• Limitation of Liability: Shush accepts no responsibility for any loss or damage to merchandise left on our premises. All merchandise is left entirely at the owner's risk, which includes (but is not limited to) damage, theft, or accidental loss.

3. Quality, Condition & Seller Warranties

• Condition: All consigned items must be delivered to Shush in excellent, "ready-to-sell" condition, fully cleaned, and on hangers where applicable.

• Disclosure: The Owner must disclose any and all flaws, wear, damage, or alterations (regardless of size or visibility) prior to acceptance.

• Undisclosed Defects: If damage or alterations are discovered that were not disclosed, Shush reserves the right to terminate the agreement immediately. Any cleaning or repairs required to make an item sellable will be charged back to the Owner.

• Ownership Warranty: You guarantee that you are the true, lawful owner of all consigned items and have full legal authority to sell them. You agree to indemnify and hold Shush harmless against any claims, damages, liabilities, or legal fees arising from disputes over item ownership.

4. Identity Verification (KYC)

• To comply with legal requirements and process cash payments, Sellers must provide valid photo ID and proof of address (e.g., Passport, Driving Licence, Utility Bill).

• In-Store Visitors: Please present your original physical ID documents when dropping off items or collecting funds.

• Remote Sellers: If you cannot visit our store in person, you must email high-quality digital copies/images of your identity documents to our team prior to payout.

5. Authenticity & Authentication Fees

• Authenticity Commitment: Shush accepts only 100% authentic designer items. All items undergo rigorous authentication before being offered for sale.

• Holding Period: Items must be left on-site for a minimum of 48 hours for testing and evaluation, which may include verification by independent third-party specialists.

• Authentication Charges: There is a standard processing fee for verifying the authenticity of high-value items (including watches, jewellery, and luxury handbags).

• Counterfeit Items: If an item is determined to be counterfeit, the Seller is strictly responsible for covering the full authentication fee before the item is returned or disposed of.

6. Pricing, Commission & Buyer Installments

• Agreed Selling Price: Selling prices are mutually agreed upon between Shush and the Owner prior to listing, based on brand, style, condition, and market demand.

• Commission Split: Standard sales operate on a 50/50 split after VAT on the final selling price.

• High-Value Items: At Shush's sole discretion, a higher payout rate (up to 70% to the Owner) may be offered for exceptionally high-value or rare key items.

• Direct Buyout: Shush reserves the right to offer a direct purchase/buyout of consigned items at or above the agreed minimum net payout.

• Buyer Installments (Layaway): We may occasionally allow Buyers to pay for an item in installments over a maximum period of 3 calendar months. Shush London guarantees that the Owner will receive their full agreed payout at the end of this 3-month period once final payment clears.

7. Proceeds & Payouts

• Payout Schedule: Proceeds from sold items are paid out at the beginning of the calendar month following the completed sale and clearance of funds.

• Payout Method: Payments are processed via electronic transfer or cheque/cash (subject to full ID verification as outlined in Section 4).

8. Online Buyer Terms (Returns & Shipping)

UK Purchases

• Right to Cancel: In accordance with UK Distance Selling regulations, online UK Buyers have 14 calendar days from delivery to return an item.

• Condition & Security Tags: Returned items undergo strict quality control. Returns are only accepted if all original "Do Not Remove" security labels remain completely intact and attached. Items must be returned in the exact condition sent, complete with all original packaging, dust bags, and accessories.

• Return Shipping: The Buyer is solely responsible for all return shipping costs and risks.

• Refund Processing: Approved refunds are processed within 5 to 7 working days of receipt back in-store, issued to the original payment method used.

International Purchases

• Final Sale: There are no returns or refunds for any purchases made from outside the UK. All international sales are final.

• Customs & Duties: Buyers outside the UK are solely liable for all import/export taxes, customs duties, and local clearance charges.

Acknowledge & Agree: By signing the consignment agreement, submitting your items, or agreeing to list with us, you confirm that you have read, understood, and agreed to be bound by these Terms & Conditions.
